New Regulations for online gaming in India
The Ministry of Electronics and Information Technology (“MEITY”) on 6th April 2023, notified the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Amendment Rules, 2023 to create a new co-regulatory framework for Online Gaming Intermediaries (“OGI”). These changes will be known as “gaming amendments.”
These guidelines attempt to compel online gaming platforms and social media intermediaries to exercise greater caution when it comes to online games and false information. The following are the key aspects of these new rules:
- The new guidelines describe an ‘online game as “a game that is offered or available on the internet and is accessible to a user through an intermediary or any computer resources”. An “online gaming intermediary” is someone who offers one or more online games (through the Internet).
- The Ministry may designate as many online gaming self-regulatory bodies as it may consider necessary for the purposes of verifying an online real money game as a permissible online real money game under these rules.
- SROs will declare the permissibility of online gaming. It will focus on whether the game incorporates wagers and will operate as scrutinizing online real money games, stating that it shall not feature gambling on any outcome.
- The rules enable an aggrieved user to have an option to appeal before the Grievance Appellate Committee (GAC) against the decision of the Grievance Officer of the online gaming intermediary concerned in case the above specified disclosures under the rules are not conveyed to the users by such online gaming intermediary.
- Self-regulatory body shall publish and maintain on its website, mobile based application or both, at all times, an updated list of all its members, whether present or former, the dates of their acceptance as member, their corporate or business-related identity number and other details, and the details of suspension or revocation of membership of any member..
- Banned games: New sets of updated regulations will pass the permissibility of online games on a basic premise, regardless of whether it includes betting or gambling in any way. Other types of games are permitted.
